Sexual Harassment

This is where there are unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature, made by one person on another. Repeated, unreciprocated and unwanted verbal or physical approaches.

Sexually explicit and derogatory statements which are found to be objectionable and offensive and make the recipient feel threatened or humiliated; suggestive remarks; compromising invitations; demands for sexual favours.

Even if the boss is unaware that someone in the office is being harassed, the business owner can still be held responsible. For action to be taken, the conduct must be sufficiently frequent or severe to create a hostile work environment.

English and Scottish law does protect people against sexual harassment, so you must make sure your workplace does not nurture it. It is advisable to make sure employees understand the situation with harassment by training and creating a comfortable workspace. Also establish a process for reporting sexual harassment.
